Nature of the service
CallGen is a B2B SaaS platform for business communications with AI agents, voice, chat, SMS/WhatsApp/email, shared memory, CRM/contact context, recordings, transcriptions, live supervision, workflows, tools, APIs, billing, wallets, and external integrations.
Account registration
Users must provide accurate account information, protect credentials, and keep workspace access limited to authorized personnel. The customer is responsible for activity under its account and workspaces.
Workspace use
Customers are responsible for the data, prompts, files, contacts, CRM records, workflows, calls, messages, and tool/API instructions they upload or configure in their workspaces.
Administrators control members, roles, permissions, integrations, phone numbers, billing settings, agent configuration, and workspace-level data.
Wallets, usage, and add-ons
Charges may include wallet top-ups, plan fees, add-ons, calls by minute, SMS or messaging fees, workflows, storage, RAG usage, concurrency, numbers, integrations, and other metered capabilities shown in the product or order form.
Stripe payments
Payments may be processed through Stripe. CallGen may store payment references and billing history, but card processing is handled by Stripe subject to Stripe's terms and security controls.
Refunds and cancellation
Unless a written agreement states otherwise, prepaid usage, consumed minutes/messages/workflows/storage, custom work, and add-ons are non-refundable. Customers may cancel future service according to the product flow or written contract.
Suspension
CallGen may suspend accounts, workspaces, agents, calls, messages, tools, or integrations for non-payment, security risk, legal risk, abuse, prohibited use, excessive failures, or harm to the platform, providers, users, or third parties.
Third-party services
The service depends on providers such as Twilio, OpenAI, Stripe, Google, Meta, ElevenLabs, Deepgram, Odoo, Cloudflare, hosting, infrastructure, security, and email providers. Outages, limits, policy changes, or suspensions by those providers may affect CallGen.
CallGen may integrate with third-party services authorized by the user or workspace administrator, including Google Calendar. The customer is responsible for authorizing, configuring, and using integrations according to its permissions, notices, consents, and legal obligations. Agent actions depend on the customer's configuration, authorized tools, permissions, provider APIs, and workflow instructions.
Intellectual property
CallGen and its software, designs, workflows, documentation, brand, and platform technology remain the property of CallGen/Gepeto or its licensors. Customers keep rights to their customer content, subject to the license needed to operate the service.
Customer content
Customers grant CallGen the limited rights needed to host, process, transmit, analyze, and display customer content for service operation, support, security, billing, and compliance. Customers must ensure they have rights and lawful basis for all content and contacts.
Limitation of liability
To the maximum extent permitted by law, CallGen is not liable for indirect, incidental, consequential, special, punitive, lost-profit, lost-data, telecom, AI-output, third-party-provider, or customer-configuration damages. Any aggregate liability is limited by the applicable contract or fees paid for the affected service period.
Availability
We work to provide reliable service, but availability may be affected by maintenance, emergencies, internet or telecom failures, third-party providers, model providers, compliance holds, or customer configuration.
Termination
Either party may terminate according to the product flow, order form, or written agreement. After termination, access may end and data will be retained or deleted according to the Data Retention & Deletion Policy and legal obligations.
Jurisdiction
Disputes are subject to the competent courts agreed in the applicable order form or, if none applies, the courts of the provider's principal place of business, unless mandatory law requires otherwise.
Changes
We may update these terms. Material changes may require re-acceptance for continued use, especially for accounts created before a major version change.
